ORDER DENYING DEBTORS’ MOTION FOR APPROVAL OF
REAFFIRMATION AGREEMENT On December 5, 2006, Debtors filed a
voluntary petition for relief under Chapter 7. On March 22, 2007, the
Court entered an order granting Debtors a discharge under 11 U.S.C. §
727, and the bankruptcy case was closed. On April 3, 2007, a
Reaffirmation Agreement between Debtors and Citizens First Savings Bank,
and “Debtor’s [sic] Motion For Approval of Reaffirmation Agreement” were
filed. (Docket # 36.) Under 11 U.S.C. § 524(c)(1), a reaffirmation
agreement is not enforceable unless it “was made before the granting of
the discharge under section 727.” The reaffirmation agreement
in question was executed on March 26, 2006 by Citizens First Savings
Bank, and therefore was made after the § 727 discharge was granted. As a
result, the reaffirmation agreement is
not enforceable. Accordingly, 2 IT IS ORDERED that Debtors’ motion for
approval of the reaffirmation agreement between Debtors and Citizens
First Savings Bank filed on April 3, 2007 (Docket # 36), is DENIED. . Signed
