Amended Voluntary Petition

Effective on January 1, 2008

The Executive Committee of the Judicial Conference has approved amendments to Bankruptcy Official Form 1, the Voluntary Petition. The amendments make the Official Form consistent with new Bankruptcy Rule 9037 by requiring that filers redact individual taxpayer identification numbers (ITINs) as well as social security numbers. The amended form, which is posted here, will be effective on January 1, 2008.

Amended "Means Test" Forms

Effective on January 1, 2008

Amended "means test" forms have been approved by the Judicial Conference. The amended versions of Bankruptcy Official Forms 22A, 22B, and 22C posted here will be effective on January 1, 2008.

Proposed amendments to the three forms were published in August 2006. Because the "means test" forms are based on the national standards and local standards set out in the Internal Revenue Service's Collection Financial Standards, additional, conforming changes to Forms 22A and 22C became necessary. In order to reduce possible confusion, action also was deferred on the proposed revisions to Form 22B.

Although the pending amendments will not be effective until January 1, copies of the amendments and the revised Committee Note are posted here in order to give the courts, attorneys, software companies, forms publishers, and the public as much time as possible to implement the revisions.

Amended Bankruptcy Official Forms

Effective on December 1, 2007

At its September 2007 meeting, the Judicial Conference approved proposed amendments to Bankruptcy Official Forms 1, 3A, 3B, 4, 5, 6, 7, 9, 10, 16A, 18, 19, 21, 23, and 24, and new Official Forms 25A, 25B, 25C, and 26. The amendments to the existing Official Forms were effective on December 1, 2007. New Official Forms 25A, 25B, 25C, and 26 will be effective December 1, 2008, to coincide with rule amendments taking effect on same day.
